I read that there are 2800 EB3-I visas a year, or about 233 visas per month. Assuming there are about 700 numbers available for the rest of the year 2010, using the data in the latest May-2010 I485 inventory, the calculation is pretty straight n easy with no spillover calculations involved ... here is a possible progress of the PD:

Hi
I consulted 2 attorneys.
One said you should be able to travel on valid H4 (which I have) and be back in U.S before Oct 1st without any impact on COS.
Other one said i need to get H1 stamped in India (which I don�t want)
I don�t know whom to trust. :confused: If anybody has personal experience regarding this I would really appreciate if you can let me know.
I have to know early as I need to travel to India urgently.

One of my close friends is considering running the DC 10 miler with me. She never ran or walked a race before. Hopefully she will decide to atleast walk before the end of the day. That will be good for both of us

On USCIS status, it says.." On October 11, 2007, we received this I485..." .
Processing time for TSC is Aug07.. Does this mean my case will not processed now?

please note that although you have time till august 17th to file 485, unless you get ur labor approved in July u will not be eligible. The adjustment to extend it for a month is for people who were eligible in july. Please plan accordingly.

Everyone knows that IV had requested its members to booked their ticket for 13th of Sept. Later on we have to change it to 18TH of Sept.
There are number of members who have booked their ticket for 13th of Sept. and then later have paid some fees to change it to 18th of Sept. We would like to tell each and every member of IV that IV have not reimburse anyone any fee difference that airlines have charged them. We did receive the initial request but later on they all changed their mind and said that we would not like IV to reimburse the difference that airlines have charged. WOW
Cheers to everyone who decided not to ask IV to reimburse the fee difference that they paid to Airline companies.

Chintu: Explain Wash sale rules too... taxes are a pain with day trading.
Also, ppl on H1B have to be really careful about not getting classified as "active traders." That IMHO could jeopardize status. All who want to get into day trading, do your research. Make sure you know what you are getting yourself into.
Investments are not reflected on W2. If you use a broker such as TDAmeritrade etc they will issue you a 1099
You will receive an IRS Consolidated Form 1099 - an all-inclusive document showing your reportable income and transactions for the entire tax year - if your brokerage account received at least $10 in either dividends, interest or original issue discount (OID) income, or had an equity sale, in the 2008 tax year.
- You will not receive a Consolidated Form 1099 for a retirement account, tax-exempt account, corporate account or foreign account.
- In addition, you may receive a corrected Consolidated Form 1099 if you held an investment trust that reclassified income after this form was sent to you.
There are 2 sets of rates.
1. Short Term Captial Gains
2. Long Term Capital Gains Taxes
Short term capital gains taxes are on stocks that have been held less than one year before selling.

Thanks fo rthe reply, in my case, it was not a mistake by the registrar, my grand parents just happened to give ' a name' and when my parents enrolled me at school, they gave my current name. I am not sure, if I hav a official govt doc saying my current name is the changed name from my old name, will this help as a valid document.
I see, but from immigration perspective, your name don't match. Given the time limitation that's what I will recommend:
1. Be truthful.
2. Get affidavits from your parents or elders who were around when you were born (separate affidavit from each individual)
3. Submit incorrect Birth certificate (since u do have a birth record, they will not issue you a Non-availability certificate).
Keep other supplementary docs (For ex high school marketsheet) handy, but do not submit unless asked for.
I went through hell fighting the case (may be unnecessary) in the court, but I wanted to prove my point and test indian legal system.
Do not take much stress. Get the affidavits and go for it...

The FIFO policy applies (i know, i know, there are lots of exceptions) to applications in a particular category. In fact, for those who have PDs before the current cutoff, there is no FIFO. I know that you have been harping on this for a long time that eventually EB2 will be held back in favor of EB3, but there is no logical basis for this argument. Why isn't EB1 for the retrogressed countries backlogged? With your logic, there should be a time when EB1 is held back for EB2 and EB3 to catch up.
The fact is that most of Pre 2004 EB2 lot is already out of the system. Those who are still in are sufferer of namecheck and BECs.There is no perfect mechanism to determine the ratio but I would guess 80% are out from that group. Second factor what we need to look is Most of EB3 Mid 2002 to Mid 2005 are still in the system. Third factor what we need to understand is that EB3 filing is always more than double of EB2. It is just not enough to add a new member to IV. In my opinion, we also need the new member to be proud of associating himself/herself with IV.
Here is what every new member needs to be made aware of-
- What IV has achieved in the last year of existence?
(Manager's amendment, media interviews including the Reuters article plus the last minute attempts in the lame-duck session)
- IV is the **only** grass-roots organization in the US working towards issues of Skilled Legal Immigration. The affected people in retrogression runs close to a million.
The thing I am driving at is that new members join and do not persist with IV because they have not been made aware of what IV is and what it has achieved.
It is not about IV core members alone, the issues at hand are affecting YOU!!!!

My best guess is the USCIS people do not want to work. If the move the PD's, then they have to scan millions of files to find which ones are having the PD current. So, it is in their interest to not move the PDs.
I think they will again open gates for a month like last year and then approve whatever file comes in their hand and that way not have to work or find the files with the PD current. So, the lucky ones will get approved and unlucky ones will keep sitting until next year (no matter what their PD is ). So, sad what kind of organization is it, no accountability and no performance checks on them.

Mine was TSC...Actually it was NSC, but transferred to TSC during July fiasco..
Subkamnaa & Congrats friend. My PD is earlier than urs - Oct 05 . No LUD on mine. What is the July fiasco .
My PD is already current as of now. But there is no movement on my appl - but its just few days past its current status. I am on EB2 with PD of Oct 05 and Serv Center is NE where I got Labor and 140 approved.
Now I am no longer in that state because my project got over in NE. I am working in CA since 08 and filed 485 from CA .
Is there something that if I am in CA a different state from where I initially filed labor - it can cause RFE.
