This question has been posed before but I did not find answers so am posing too: When can one travel safely to India after applying 485?
1) If EAD and AP are filed along with 485, how long will they take to arrive. Service center dates indicate that EAD and AP currently at Jan 07. Does that mean that they are taking over 4 months to issue EAD/AP?
2) There is a an Interim EAD. Is there an interim AP if AP is pending for over 90 days?
3) Is it possible to request EAD/AP at a later time?
4) My H1B is up for reneval in Oct 07. Can I get a 3 year extension on H1, apply for a H1B visa in India and travel back to US on this? Would this be a faster option?
5) When do FP notices typically come out after applying for 485?
6) What is the grace period for FP if one misses the deadline (Is it still 12 weeks? Will the new rule to remove 12 weeks on RFE/NOID have an impact on FP?
7) If you are using an attorney for 485, will all such notices (FP, etc.) go to the lawyer as well. The concern here is that if the notice comes to my home address and I am out of the country then I am liable to miss that appointment.

I just wanted to say that the rally, all the pre-rally prep, and meeting with lawmakers was such an intense and exhilarating experience! I feel so priviledged to have met some of the core IV people - I felt like a groupie meeting superstars! They are truly inspiring... There were so many other wonderful people I had the chance to meet who now make my wait more meaningful. It was such fun getting to know all of you and sharing the experience. I have wonderful memories of the entire event...

We all had a sigh of relief when we saw the new labor certification process (Perm) and were promised that it will be much faster and smooth. Thankfully they have kept their promise, for the most part, except for the cases that get audited.
The cases that are 'randomly audited' have been pending for months and months, some cases () have been pending for over an year and there have been no response from DoL what so ever. I understand that a year does not sound bad especially to those folks who had their labor approved through the old process but these days the labor is getting approved within 50-60 days (average). It appears that the DOL (Atlanta Processing Center at least) does not bother to look at the documents once the audit has been replied to.
Although I understand that not everyone uses and some audit replies may have been replied sooner and were never reported to but you can get the idea just by a sample of the cases that were audited, and see that they have being neglected, ignored or appears that they are no longer considered for further processing. I have seen instances where the lawyers have retreated the application in the audit and filed a new application (a gamble) hoping that it does not get audit this time around. But not sure how that turned out.
If you visit the Atlanta Perm section on you will see the people's misery I mention here. In fact, I am sure that there are number of IV members who are going through this aggravating process but are silent becuase they know that can not do anything. Even lawyers have shown the sign of disappointment to this hopeless condition.
So I ask you, Members of IV, to help us and suggest something that (we) can be done to bring this to the attention of some sort of authority that would help trigger the review of Audit responses.

I applied for a new passport from the Indian Embassy in Washington DC in Nov '06 as my old one was expiring. Got the new passport in 2 weeks from the day I mailed the application.
Don't bother calling them . You will not get through to anyone. Just wait it out . It should come in 2 weeks.

Retrogression in Various Steps of the GC process
While January 2005 was the first time since July 2001 there was retrogression for the EB-3 category (01/01/02 for both China and India), the US continues to maintain protectionism through their immigration system.
Retrogression in Labor Certification: Between 2002 and 2005, there was severe retrogression as far as labor certifications were concerned. Then came the PERM in March 2005 and for a couple of years, they boasted labor certification with 3 to 6 months time. Of late I think it is taking more than 6 months for LC approvals even through PERM.
Retrogression in I-140 Approvals: I do not remember when the USCIS suspended the premium processing for I-140 but even before they did that, they managed protectionism by delaying the approval of I-140. As per some one's posting, it is now taking 14 months for an I-140 approval.
Retrogression of I-485 Approvals: Post July 2007 VB, even a 1st year engineering student from India, studying the American immigration system, can tell you it could take years (not the current 6-9 months processing time) for approval of I-485s. The delay in approving an I-485 petition is not subject to the the July 2007 Visa Bulletin alone, it cannot also escape 'protectionism-tainted' FBI name check delay.
I may sound like quite a pessimist, but add to all this the possible denials for PLC (permanent labor certification), I-140, EAD, AP & I-485s.

Yes, that would be me. Mine was approved at NSC. Got the email at 11am PDT.

Hope and wish they are many.. which would helps many people waiting in line and PD not getting pushed back for FY '10. I feel bad for EB3 folks though, seems like nothing going to change for them at least in near future, untill there is some congressional action. Hopefully the next VB gives some indication on how things are going to move. Good luck and wishes to all who got greened, especially with older PD's who have been waiting for years. I don't know much about the process...but can't you just scrap your old labor...file with PERM (15 day preperation time, 1 mth Ads, 1 mth waiting period -- puts you in sept 1st), Labor cleared in 3 weeks (sep 21st) and then file 140 & 485 together. Might cost you like 10,000, but in my books its totaly worth it, if you & your wife get an ead even 6 mths earlier.
Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

There are thousands of anecdotes that I could share. My best is the look of shock on one of the IV member's face when I asked him to escort one of the lawmakers who attended the Monday evening reception dinner. We couldn't believe that we see him on C-Span and he is standing next to us and supporting our cause.
- Can you imagine the feeling when a lawmakers says I know about you guys. You are doing a good job. This shows we are visible in the Hill.
- I felt great when I saw the confidence on the smiling faces of IV members when they came out of lawmakers meetings. For those who missed this historic opportunity, I can't even begin to explain the change in mindset from the initial apprehension about visiting a lawmaker's office to, "Why do I only have three meetings set up, I want to fill in for others IV members who might not have shown up due to various reasons"
For those demanding immediate results when they themselves might not have showed up at the rally the answer is, we will get our green cards eventually. There is absolutely no doubt about that in my mind but these experiences and memories will be cherished for a long time. This is also important to me. This new "experience capital" which was initially present among just the core members has trickled down to other members, we are growing in strength and reach our goal soon.
I am glad I went for three days. I wish I could stay longer.
