My best guess is the USCIS people do not want to work. If the move the PD's, then they have to scan millions of files to find which ones are having the PD current. So, it is in their interest to not move the PDs.
I think they will again open gates for a month like last year and then approve whatever file comes in their hand and that way not have to work or find the files with the PD current. So, the lucky ones will get approved and unlucky ones will keep sitting until next year (no matter what their PD is ). So, sad what kind of organization is it, no accountability and no performance checks on them.

Have you guys read an article from NY times that someone has posted at :
http://immigrationvoice.org/forum/showthread.php?t=19092
The lesson learned is media attention works. They wrote to NY times and the action was taken. (either good or bad, something happens). May be if we could also do something along the same line for PERM cases which has been pending for months and months. Just a thought....
I was also thinking how can we get as many people as we can have to sign a letter which hopefully the attorney will draft for us. There are many cases on but how could we have them all to sign the letter. We can post on forums but do all those people read the forums there ? I personally many times just hit the site to see had there been any updates and left without even logging in or check the forum. What could be done to let the people know about our movement so that when the draft is ready, we will get as many signatures as possible.

This all comes down to the political appointees at high posts at DOL/USCIS. President Bush does not nominate them based on merit, effective leadership qualities, and compassion for workers. It is all done on loyalty basis and party politics.
Because courts do not intervene or past attempts at litigation failed, all these people are sitting pretty. Shame on them.

Received our approval notices in the mail today. Infact, our immigration attorney received them first. No emails, no SMS, no SRs. Online status still shows "Initial Review".
Its been almost 10 years to the date. I wish all my friends on IV good luck and hang in there.
Along the journey, IV has provided a lot of help & support and I will certainly be sticking around to help in whatever way I can.

I think the current state of disagreement is good because at least everything is out in the open and up for fighting. If this bill had to be scuttled it could have been done very quietly. But there are enough people out there who will make sure that there is no easy death for this bill. It is a fight and a lot of egos will need to appeased in the process.
How much will we gain out of it in the end as skilled legal immigrants may not be necessarily in our control during this whole process as illegal voices are more stronger and we are really considered compromisable. It will be up to our well wisher politicians and vested business interests to push something in our favor.

How much clout does this congresswoman have? She seems to understand the entire scenario better than any american soul out there! It also seems like she has spent a lot of time on this and understands the system very well.
I guess it remains to be seen what kind of impact her letter will have on USCIS. Obviously, USCIS did something unlawful.
She understands it better because look at her biography:
http://lofgren.house.gov/biography.shtml
Professional Career
Served as Staff Assistant to her predecessor, Congressman Don Edwards, 1970-1978;
Worked on impeachment proceedings, the Equal Rights Amendment, and creation of the Don Edwards National Wildlife Refuge in the South San Francisco Bay
Practiced immigration law as a partner in the firm of Webber & Lofgren, 1978-1980
Taught immigration law at University of Santa Clara School of Law, 1977-1980
Served on Santa Clara County Board of Supervisors, 1981-1994
U.S. Congress
Elected in 1994 as only freshman Democrat from west of the Rocky Mountains
Serves on Committee on the Judiciary:
Chair of Subcommittee on Immigration, Citizenship, Refugees, Border Security and International Law
Subcommittee on Administrative Law
Serves on Committee on Homeland Security: Subcommittee on Emerging Threats, Cybersecurity, and Science and Technology
Subcommittee on Border, Maritime and Global Counterterrorism
Serves on Committee on House Administration
Chair of Subcommittee on Elections
Serves as Chair of the 34 Member California Democratic Congressional Delegation

The situation is the same. In my case and of course in most of others too, what he/she said is correct. Waiting for Eb3 to cross 2001 has become a difficult thing. If I started an EB2 app rather than hoping positively, I would have finished my wait for GC.
Ever since retrogression started the dates have not crossed 2001. 245i or not, the backlog is a fact. Sad part, when there is action items from IV, trying to talk to my state members, I have realized and been told that IV does not cater to EB3 anymore. It is disheartening how much ever I try to explain, occasional members look at IV threads like EB2-EB3 predictions and say there is no hope for EB3 and also IV has no answer to it.
I tried my part...too bad I was not able to participate in the IV advocacy day due to family emergency. anyway, let us hope IV's persistence yields us the results. My heart goes for a lot of EB3s who may automatically qualify for EB2 just due to their experience.
Best of luck to all.
Kartikiran, I suggest that you post a few questions to the people who attended the DC event - Ask them if any of the staff members they met with asked them about EB2 or EB3. Ask them if these words were even mentioned.
http://immigrationvoice.org/forum/forum16-iv-agenda-and-legislative-updates/1598012-live-updates-advocacy-day-event.html
These are people who actually took action to do something positive instead of just talking. I wish you were able to participate in the event - you would have known the facts instead of half truths.... Hope whatever the emergency was taken care of - maybe you can participate in the next event yourself......
By the way, who in the IV told you that "they have no answer for it" ?

my answer to Q 16 was C9 and the instructions said that for C9, send it to NSC for applicants living in CA. Hope this is correct!
Read the instructions again. It says Phoenix, AZ
Anyway, donot worry much -As per new instructions it will come back to you with a note to mail it to the correct address. Wish they could just forward to AZ

And check out my signature - finding your state chapter and becoming a member is easy. I have had this for over a year now
regarding the state chapters
this is what i found on the page following your link
State: Southern California
Name: Santhi Boppana
IV handle: santb1975
Leaader Name: Pancham
IV handle: prp925
Leader Name: Puneet
IV handle: Paskal
State Group email/URL: SC_Immigration_Voice : Southern California Immigration Voice (http://groups.yahoo.com/group/sc_immigration_voice)
At first i thought there was no state chapter for California. Only after searching the page for the word "california" did i find the ones for Southern California and Northern California
which are not states but just different parts of California.
Was i supposed to magically just guess that it is listed this way...or am i a moron who just does not understand this simple thing?
